my father died without making a will.now my broher and sister want partition of property .its ok i donot have any problem with that but they are not accept any amount of money i give to my father . and i donot have the any written proof about this money.

It is but for natural that you don't have any proof of giving money to your father and in absence of the same you cannot claim money from your siblings. Only internal understanding can resolve your case.

I agree with the views of Vishal sir. Try to resolve the matter amicably.

No legal way out. Only and only family settlement is the best solution otherwise you sacrifice being elder brother and forget what you had paid to your father. After all he was your father and you are earning now property in his inheritance.
adv. rajeev ( rajoo ) (Expert) 04 November 2009
No chance when u dont hv any proof it is not easy to claim that u had paid money to your father. So it is better to resolve the problem by way of compromise with the help of elders of the society and elders in your relation.
