Share in property of deceased minor

(Querist) 07 June 2017 This query is : Resolved
Hello sir,
My grand father has gifted me and three other grand children with a property. In the document, demarcation of land is not done between the grand children. At the time of registration, one of the grand children is a minor and unfortunately, he died after becoming major.
Now I want to purchase the share of the deceased person. who is the owner of the deceased person's share? who should sell me the share? will his mother gets rights over the share or how?

thankyou in advance

Who would be selling share of deceased brother, does he have any LR including your mother?

Discuss the issue with a local lawyer for proper guidance.

Adv. Yogen Kakade (Expert) 08 June 2017
The legal successors shall be able to sell the property to you.

If deceased owner (male) has not left any valid WILL:

The ClassI legal heirs shall have 1st right i.e; Mother (if alive as on date of death), Wife (if alive as on date of death), sons and daughters...............

If deceased has not left any wife,sons,daughters................then Mother is sole surviving ClassI legal heir and shall inherit 100% of property of her deceased son.

The process/procedure/forms for such simple matter of inheritance ( Intestate Succession) may be available at the website of authority under whose jurisdiction property falls say: MC.

Or can be collected from O/o authority.

Certified copy of death certificate, legal heir certificate/affidavit as applicable and per precedence at your location are basic requirements.

Legal heir certificate is usually issued by O/o Tehsildar..........
