Share of grand mother

Dear Experts,
40 years back my Father got a Share “ Y ” through a partition Deed (The partition between My Grand Father- Share-“X”,My Father- Share-“Y”, and my Father’s three sisters -Share-“ Z1, Z2, Z3 ”,),my father expired in Dec2002 and my grandmother expired in Jan 2013.My query is whether my grandmother is eligible/rights for any share from My father’s share “ Y ”. If she is eligible for a share from Share “Y”, who will get this share after her death (she has died without will/document), .This query is only about share “Y” only, not about share “X”.

Pls give ur valuable counsel.

Since your grand mother was alive when your father died, your grand mother is entitled to an equal share as a heir, from your father's property.

After the death of your grand mother, since she has not left any will, the property in her name will go as per Sec. 15 of the Hindu Succession Act, 1956 as under:
(a) firstly, upon the sons and daughters (including the children of any pre-deceased son or daughter) and the husband.

(b) secondly, upon the heirs of the husband.

(c) thirdly, upon the heirs of the father, and

(d) fourthly, upon the heirs of the father, and

(e) lastly, upon the heirs of the mother.

Property Y shall be distributed among all the sons/daughters and your grandfather, if he was alive at that time. Sons/daughters include the legal heirs of the predeceased son/daughter as one unit.
