SHARING OF MAINTANACE CHARGES

There are differences of opinion on sharing of common maintanace expenses w.r.t.our flat situated at cochin.
1 view:- It should be shared basis the sft.area owned by the flat owners.
2. view:- It should be shared equally by the flat owners irrespective of area owned.
Pls inform which is right? whether salary paid to the security personnel,cleaning workers etc. can be treated as common expenses?

In my opinion sharing the expenses is prudent irrespective of the area owned. For example a person residing in the ground floor may own 1000 sq ft area, whereas a person having a lesser area may rside on the top floor, the GF owner doesnot use the lift, then in such a case need he to pay the lift maintenance. Similarly expenses incurred towards security, cleaning etc... is to be treated as common expenses.

The Payment of Common Charges is regualted by Sale deed terms and the Building Society/Assocaition regualtiosn/Rules , in the absence of the same , the monthly mainataianance charges shall be paid by all the occupants in equal sahres
with regqard !

Both the view have its own merit and demerit.But if compare the views closely,I think second one is more convenient.
