Shop vacant , immediate relief

Dear Sir ,
1) My father in law given rent of two shop to different people in 2008 , for
1 years renewal contract.
2) Shop keeper has paid on only one month rent in 2008 , they have just one rent receipt.
3) In 2009 , father in law file file eviction suit . After that due to poor health &
financial condition , he could not fight the case .
(his office lockout , still not got any benefit)
4) The shop keeper once send rent by money order , my father in law denied to accept. Later , they are not paying
rend for 8 Years.
5) My Father in law's , elder sister in a worst sitauion , her husband got blood cancer (last stage),
She has a girl child of 15 years .
6) My Father in law want to give shop to his elder sister so that the family can sustain.
(transfer ownership)
My question is that , is this will be the solid ground to vacate the shop ?
As this family need immediate relief , can we ask for speedy trial from high court ?
Can we ask pending rent from the shop keeper ?

Apparently the owner has erred.
The owner can ask the tenant to vacate.
It shall be certainly better show everything on record to proceed further.
Approach a very able counsel.

you have not mentioned in the question, in which state property is existing and what is amount of rent. This is important to answer your query. Please repeat with the said information.
