Society demanding increased maintenance chgs

(Querist) 27 January 2017 This query is : Resolved
I live in a SRA building where builder gave us 01 Room against room owned by my father in chawl. Society initially took maintenance charges @Rs.500/-pm as it was taking from everyone but now they are demanding @Rs.750/-pm saying we are given room under private quota by builder. Is this justified?

Sir,

It all depends on the terms of the Registered ownership document.

Good Luck,

1. Society is a coop. movement based on "Equality and Mutuality".

2. Society can collect its "service & Maintenance" charges "O N L Y" in equal proportions from it members, irrespective of any criteria or condition. Which means Society CANNOT collect different charges from different members.

3. Society becomes prosecutable for negligence and deficiency under the Consumer Protection Act, for collecting "un-equal" (non-equal) charges from its members.

Keep Smiling .... Hemant Agarwal
