Second Appeal-544/2009 in Patna High Court

(Petitioner)Kamla Devi Vs Ishwar Dayal Dubey(Respondent)

Heard learned counsel for the Appellants and the learned counsel appearing on behalf of the Respondent. Admit. Call for the Lower Court records. The substantial questions of law involved in the present appeal under Section 100 of the Code of Civil Procedure is as follows:-

(i) Whether a document of compromise in a partition suit allotting shares to the members of the joint family needs to be compulsorily registered under the provisions of the Indian Registration Act, 1908, so that such document is admissible as evidence?

ii) Whether the said document of compromise could have b
eeen treated to be inadmissible piece of evidence for the sole reas
on that it was not
registered?

Any other substantial question of law which may arise at the time
of hearing of the appeal.

May please suggest the possible course of action from the aforementioned question of law formulated by one Justice in 2013 at High Court Of Patna. Second appeal of title suit is related to ancestral land and property partition case.I am a respondent in the admitted second appeal at High Court.
Previously I had won the case in the fast track court,Ara and before this I had lost the case at the Sub Judge,District Court,Ara
Can you please throw any light in the stated question of law….
