Specific performance

(Querist) 08 August 2012 This query is : Resolved
can I institute a suit for specific performance of a sale Agreement of the year 1995 ? Is there any limitation to it? if the Agreement values one lac and seventy thousand where can it be done i.e in which court?
J K Agrawal (Expert) 09 August 2012
Limitation is generally 3 years only but looking at the wordings of agreement it may have some extended time.

The Law about the Court may be different in each state and depends upon the place in which state the property situates but generally it is The Court of District Judge (or ADJ at your town) who hears matters above Rs 50,000/-.
