Respected experts,
There is a case pending under section 498 from 2008. and A1 is absconding till date. after court had issued notice to the other accused a2 and a3 appeared in the court recently. from Dubai . and now ,they filed a petition for splitting the case saying that they don't have any idea about the whereabouts of there A1. but it is wrong they have complete knowledge of a1 .and they are still in touch with him.is accused have a right to give a petition asking for splitting? if so, the complaint give a counter for refusing it? will the court agrees for it?
the defacto complaint don't want for splitting the case. is there any section which can prevent this?
please i need few judgments of the same if it happens in any court
