Spouse ground transfer

Hello Sir,
I and my husband are both working for the same PSU bank where my husband is posted in Tamilnadu & I am posted in Chhattisgarh. I had applied for spouse ground transfer to Tamilnadu and even received the transfer orders from the central office where it is mentioned that my services have been transferred with immediate effect in the month of January. But the problem is that I am yet to be relieved from Chhattisgarh and its been 3 months post the transfer orders. Our transfer policy says that "it is at the discretion of the bank to issue transfer orders on such ground subject to vacancy in the concerned state to where transfer is sought". There is no mention of any reliever for excersing spouse ground transfers. Everytime I approach them, they talk of substitutes.
Please sir, I request you to kindly advice on this matter and throw some light on the spouse ground transfer if actually having a substitute is a criteria for effecting spouse ground transfers and is there any time frame within which such transfers should be effected as per Govt guidelines.

Dear Deepika,
There is no government guidelines on this. In any case, nobody, including you, would relieve anybody without a substitute.
But, if the transfer had been sought by your husband from Tamilnadu to Chattisgarh where you are posted on the same 'spouse' ground probably he would have been relieved at the first instance, for the substitute for tamilnadu might be available in plenty.

Hello Anirudh sir,
we had initially tried that he be transferred to Chhattisgarh but his request was not entertained as our transfer policy says "a female officer can apply for transfer to join her husband after marriage or due to transfer of her husband from the present location." According to our banks policy, spouse implies only female oficers. So he could not. And now that I have, relieving is being a major problem.

Only way out in PSU Bank is request to your seniors. Your senior has to suffer in achieving his targets if he relieves you without replacement. He can be held responsible personally if targets are not achieved. He would have to bear extra burden of work if he relieves you.
You would not be relieved till he agrees or pressure from higher officers from Tamilnadu on controllers of chattisgarh area.
You may approach personally to controllers of Tamilnadu area.

In the absence of clear-cut guidelines on relieving, only way out is to convince your boss (Branch Manager if you are working in a branch) and see that he agrees for relieving without demanding immediate substitute. The relations with the boss will play vital role in such circumstances. You should always keep cordial relations with your immediate superiors especially in PSUs. PSBs do not have strong HR and their acts are unquestionable by the unions/associations nowadays. Reosrting legal remedy also will not give immediate relief and PSBs go on fighting the legal battle as they are not the losers personally and the money spent on litigation is not their own money. I sincerely advise you to convince your boss to get yourself relieved.

Normally PSU will not relieve their employee, untill and unless they get a person for that particular post. In case of delay in relieving you, You can bring it to the knowledge of your superior officers.
My suggestion is that you can go on leave, till you get relieved. This will put pressure on the present bank manager, he will find substitute.

Though your Central Office has approved your application for spouse ground transfer, it again depends on the Branch Manager's recommendation to relieve you, who in ordinary circumstances shall not be able to relieve you without getting a reliever or replacement for you. However in case the the relieving is getting delayed inordinately, you can approach the Central office once again to intervene. You can do nothing legally about service exigencies.
