Dear Experts,
Can Mr. Y get an exemption of stamp duty in below given case?
Mr. X bought a propery (house) and registered same then He want to sale same within 6 months of registration.
Mr. Y is interested to buy the same property, then in this case can Mr. Y get an exemption of stamp duty at the time of registration in his own name within 6 months from earlier (Mr. X's) registration.
Because the stamp duty was already paid on same property by Mr. X at the time of his own purchase.
(Property Situated in Maharashtra, Mumbai)
Pls reply with any provision/ sec. if any.

the stamp duty was paid on x and registered on x name and x want to sell to y
means a new transaction is taking place on the same property by changing the name even with one day if the property is sold then again the stamp duty has to be paid

There would be no exemption from paying stamp duty.

If 1st sale : builder to Invester is registrered and sold within 6 months, major part is adjusted for 2nd purchaser on SD.

There would no exemption in your case because 1st sale deed was registered in name of x,then if y buys it even on second day from x,it would be treated another sale.
Mr. Shroff is stating circumstance which i do not find present in your case.
