Stamp purchased

(Querist) 30 May 2013 This query is : Resolved
Dear Experts,

we have purchased a Stamp Paper on 25-05-2013 for execution of rent Agreement. My query is can we make the agreement effective from a past date say 01-01-2013 or a future date say 01-10-2013. Is there any time limit for using the stamp paper ie expiry of paper.
Please guide on urgent basis.

Whatever terms that are contained in the agreement (in this case the effective date being the back date) is an agreement/contract between the parties. Stamp paper date has nothing to do with it. In other words, on a stamp paper purchased on 25-05-2013, you can make the agreement effective from a past date say 01-01-2013. It would be perfectly legal.

However, while writing the agreement it cannot be said that this agreement has been entered into between the parties on this ___ day of ____ of 2013 (This date cannot be prior to 25.5.2003) That is all.

Similarly, on a stamp paper purchased on 25.5.2013, you can enter into an agreement which is effective from a future date. This is also legal.

Dear Experts,
Thanks for the quick Reply !
What I Concluded is We can have the following wordings of agreement :
This Rent Agreement executed on 25-05-2013 :
Option A- With effect from 01-04-2013
Option B- With effect from 01-10-2013

Am I right or wrong ?
