Dear experts,
my mother wants to file a partition suit against my maternal uncles. i also want to take stay from court on that property.
my questions are :-
1) can i present my mother in mumbai court and take stay on the same day.
2) it is necessary to give legal notice first and then file a suit or we can directly file a suit.
3) Can any one suggest me good lawyer in mumbai for proceeding of this case.

1. Yes you can represent your mother on the basis of GPA. The injunction and not 'stay' which is passed in the same day in a partition suit.
2.No need to give any legal notice.
3. You better look out.

Agreed with the openion of Mr. BARMAN. But you can get only interim injunction on the same day ,if you will able to convince the court three points i.e., you have a prima facie case, you will face irreparable loss if the temporary injunction is not granted, and the balance of convinience is infavour of you.
