once the OP is declared accused by the court in private case, does it mean that charges are framed against him in a criminal matter.
Devajyoti Barman (Expert) 28 December 2010
No. The opposite party in a criiminal case is only mentiioned as accused person. Only after plea the charge is framed.
SAANJAAY GUPTAA (Expert) 28 December 2010
No, there is no such term used as OP in IPC here, accused person is the term against a private complaint case has been filed and plea and or charge is framed depends upon the sections.

At the very moment the criminal court entertains your complaint against any person, he becomes an accused.
Kirti Kar Tripathi (Expert) 28 December 2010
I agree with Devajyoti. The word ''accused'' is mentioned in the complained just denote him as opposite party. Unless charges are not framed the opposite party is not accused.
Gulshan Tanwar (Expert) 28 December 2010
Agreed with all my Ld. friends.
Ajay Bansal (Expert) 28 December 2010
NOT NECESSARY.
Arun Kumar Bhagat (Expert) 06 January 2011
The term OP is used in Revision case i.e. Opposite Party. The moment the case is filed , the person(s) against whom the case is filed becomes accused.
