PETITION TO ISSUE SUBPOENA UNDER ORDER 18 RULE 2 OF C.P.C.

If the petition is allowed you have initiate steps to send the subpoena to the witness.

If they dont turn up apply for NBW on that witness. Under ORDER 16 RULE 10(3) OF C.P.C.

In addition to advice of AurunaGiri Sir, The court may ask you to deposit required expenses of incurred on calling such witness.

The lawyer applied under CPC 151 for summoning witnesses and his application was rejected by the joint registrar. Why ? Is it neccesary to take permission of the Jr ?
