Supernumerary post and transport allowance

I am incapacitated central govt employee.. CAT chandigarh order supernumerary post for me. And accordingly department processing the same but now pay given to me is only Basic + DA. Service benefits hs been withdrawn such as HRA and Transport allowance and annual increments. I want to know whether I am entitled for HRA , annual increments and particularly transport allowence.

You have not mentioned the background of your case and with what specific reason the CAT ordered for creation of supernumerary post. Please clarify the on that issue first.

Also, did you join duty after your posting on the job created on supernumerary basis?

prima-facie an officer on supernumerary post is entitled for all benefits.

I differ with the view of Mr. Sudhir Kumar, apparently made in a hurry without waiting for clarification from the querist about the background of the case or his being on duty or not.

If not on duty and supernumerary post has been created merely to accommodate the lien of the querist or provided lien by creation of the supernumerary post with retrospective effect in that case transport allowance cannot be given, as the same is allowed for transportation of the employee from and to office.

Besides the query raised by Mr. Dhingra, you are required to disclose the terms and conditions of your service wherein it can be found covenanted; however, if it is not mentioned in your appointment letter seek clarification from the department/ employer.

yes. a clarification is needed as to whether or not he is attending to duties on supernumerary post.
