Supplementary chargesheet

(Querist) 09 April 2019 This query is : Resolved
If a person is under judicial custody from one year under section 420 of IPC and police filed the chargesheet within 60 days so accused can not take the benefit of Section 167(2) of CrPC. Now everytime around 4-5 time police submitted the supplementary chargesheet due to this magistrate is not framing the charge so trial is not going to start. Now can we get the bail on this ground?? Is there any supreme court citation regarding limit of supplementary chargesheet??

Did you file any bail application earlier which has been rejected by either of the Courts?
Consult a local senior for better appreciation of facts and guidance.

Sir lower court rejected the bail. Now we filed in high court. We need some supreme court judgement on this topic

There cannot be any judgment for giving surety in a bail matter. Every matter is different. In your case what is important to know is what new or additional facts are discovering in the supplementary charge sheet. If no new facts or documents are coming on records in supplementary charge sheet, u can apprise such things to the court while arguing your bail application.
