Supremacy

Who is supreme?

I think -

Constitution is supreme-then people -then PM - then President.

Because every body is guided by constitution people also- people elects the govt and PM- President is bound to follow the decision of govt/PM.

In any democracy only PEOPLE is the Supreme factor as without them none of the entities like PM, President or Constitution would have come into existence. In tamil there is a famous saying, "MAKKAL THEERPEY MAGESAN THEERPU"

it is a difficult jurisprudence question. for existence of a State both constitution and people are important. We may say the constitution of the State is supreme till the people accept it. If people reject it then there will be a revolution and creation of new grund norm leading to creation of a new State.

DIRECT DEMOCRACY MEAN PEOPLE HAVE THE DIRECT RIGHT TO APPOINT THE HEAD OF THE STATE.AS IN INDIA ,WE CAN ELECT ONLY REPRESENTATIVE FROM OUR OWN REGION BUT WE CANNOT ELECT PRIME MINISTER.aPPOINTING PM AND PRESIDENT IS INDIRECT PROCESS.

But you must understand that democracy is a democracy - there is no classification of democracy as direct and indirect.
But, selection of the President etc., can be either direct or indirect. But that in itself will make the democracy an indirect democracy.

AS FAR AS I M CONCERNED.SWITZERLAND HAVE DIRECT DEMOCRACY AND INDIA HAS INDIRECT DEMOCRACY AND THAT IS WHY I GET CONFUSED.

In a republican form of government, where the people have given unto themselves the basic law upon which a government has to function, then, to the people or the governed, and the government, the basic law namely constitution is supreme. Hence, when the people have surrendered some rights to the government where the governed got some assurances from the government by the social contract theory, the Constitutional Law becomes the supreme is the humble submission I want to make.

So in my personal openion constitution is supreme because the entire nation includig people are guided by the constitution.President and Prime Minister are the creation of constitution . In India President is the supreme authority. The Prime Minister is the next authority to president from the option provided by you . Even if ,people elcts the Prime Minister through their representative Prime Minister has the supremecy over the people.So in my openion the sequence is first the Constitution, then the President, then Prime Minister and at last the People.

Actually I am in confusion because no one holds the absolute authority.There is complete division of power.I feel that that considering supreme to anyone individual is unjust in india.
Eg. President is the titular head and no bill can be passed without his/her verification but at the same time president is totally dependent on the advise of lok sabha and rajya sabha.According to the constitution of india,if twice the bill is sent for verification.The president is bound to verify it.
Even his/her ordinance making power has to be approved by the council of minister.
At the same time in lok sabha political sovereign govern.I believe thatit is difficult to have complete democracy.

According to my point of view,Political sovereign can be considered as supreme looking into the recent political and social issues.
I mean by political sovereign" the political party who has majority in the central government.
Though people elect the MP but only of their own region.The people cannot elect Prime Minister.
