Surety/guarantor

Can a lady who herself is accused u/s 498A, 306 r/w 34 be a guarantor/surety to her brother. (She is on bail) The brother is also accused u/s 498A, 306 r/w 34 & now in cheque bounce case of N.I. Act u/s 138.

Yes she can stand as guarantor/ surety to her brother or any where.

TO stand surety one simply needs property worth the amount one stands surety,no other consideration is taken there.Any one may face accusation but that does not amount to conviction.But if advise is sought with reference to a surety of bail ,much depends on satisfaction of the magistrate.

Yes, she can stand provided she has the financial capacity to pay the amount in case of forfeiture of surety bond.

She is co-accused. So how can she stand surety for the same.

Kapoor where is restriction for such accused to be a surity? Even if such accused person is convicted, her property do not go with her and she still remains owner thereto so she can become surity.
