(Querist) 04 November 2014 This query is : Resolved
Dear experts ,

I am a salaried employee in a state govt department . TDS deducted from my salary . I have a FD . I have a agriculture income also . I have given my agriculture land to my brother on lease . every year he gives me 60000 ( average of 15 years ) from last 15 years . Since i was receiving lease income i rarely used my salary income , i also used my agri income to make an fd , i have also received cash gifts from my father , mother and brothers also . I also made an fd with the help of those gift deeds .

Should i file an itr ? What should i do ?

As per facts of the case, filing of ITR is compulsory.

respected all experts :: Query is genuine , only it is asked by different person . Please don't take it otherwise . Please share your expertise .

legal opinion should be sought on those issues which cannot be understood by a common man.

A plumber or mason also knows that ITR has to be filed when income is accessable. TDS is deducted only when the income is assessable.

You claim to be running an institute.

If the person's income is exclusively from 'salary' alone (i.e. no other source of income like income from house property, interest income from Fixed deposits, income from buying and selling of shares etc.) and if TDS had been deducted, he need not file Income Tax Return. In all other cases, one has to file the Income Tax Return.
Kumar Doab (Expert) 10 November 2014
Computer income from all sources and file ITR...........advised the querist.
