Temporary service termination and experience letter

Respected Sir,
A temporary government servant whose service have been terminated after 4 years of Continues service under Central Civil Services Rule 5 Sub Rule 1 by paying One month salary with out holding any opportunity of hearing and the applicant have challenged the order in the CAT and it is Still Pending for final order.In the mean time due to unemployment the applicant can get another job on the basis of temporary government service , whether he is eligible for getting Experience Certificate from the Employer and if employer deny to issue the experience Certificate then What is The remedy available for applicant to Get Exp Certificate or he is not entitile for exp certificate at all.?

YES!he is eligible for getting Experience Certificate from the Employer .if employer denies to issue the experience Certificate then the remedy available for applicant to Get Experience Certificate would be seeking a direction from CAT mandating employer to issue the Experience certificate.

While I also fully agree with the experts, it is added that the senior level of the Govt. office may also be approached. The service may alternatively be proved by form 16 issued each year by the department and salary slips etc.
