original tenant grandfather . Was living with him for many years , at the time of his death and till date . Mother got tenancy transferred to her name without telling me . When I came to know filed suit for claiming my rights . Case in court since last three years . Police Inspector says that unless we get a stay from court he will evict us . Is that legal ; do we have to get a stay ?

Court has to decide and grant your prayer. The police is right since they are barred from entertaining civil disputes and they can act only upon court directives.

Perhaps my question was not framed correctly .
We have filed suit for claiming our tenancy rights . The suit is being progressed in the court . Meanwhile mother has approached police to evict us . The inspector is now saying that either we get a stay or he will evict us . My query is can he do so since it is a civil matter and is currently in progress ?

Yes in case the mother complains of tresspass the police can act upon her complaint since as per records she is the rightful owner, as advised by the inspector obtain an injunction or an order to maintain status quo until the disposal of the pending civil suit.
