This query is : Resolved
Hi
We are in the process of entering into an Agreement with our Landlord for Redevelopment of our Tenant Building.
The Queries are as follows
1) While giving sign on the Irrevocable Consent, should it be accompanied by a Permanent Alternate Accomodation Agreement.
2) Should this Agreement be Registered OR only a Notary is sufficient.
3) If the Landlord does not follow the Agreement or if he sells the Irrevocable Consent to some other Developer, will a Notarised Agreement stand as a support for the Tenant OR only a Registered Agreement will protect the Tenant in the court of law.
Thanking you in Advance

Make a Clause in Irrevocable Consent, make a clause about duties of Tenant Builder, and if the builder fails to perform these duties then the Irr. Consent will be Void Ab Initio ,
Dont just sign the papers made by the builder , show it to a Proper Legal Practitioner/ Advocate.
By Paying the fees to the Legal Practitioner/ Advocate, you will will gain , by getting proper guidance.
Ask the Legal Practitioner/ Advocate to draft a Permanent Alternate Accommodation Agreement or a Memorandum of Understanding. Then the Legal Practitioner/ Advocate shall advice you abt the registration or otherwise

Before signing any document get it vetted from your lawyer.
Give Irrevocable Consent letter with the clauses as advised by the expert Atlas Eva.
get the agreement duly registered instead of notarized.
Enter into the agreement Memorandum of Understanding and get it registered after vetting from your lawyer.

it is necessary to register agreement signed with landlord . notarised agreement wont serve the purpose . a document which is not regd would be in admissible in evidence .
get agreement vetted by a lawyer

agreed with experts opinion. Getting vetted by a lawyer before entering signature is a good suggestion.
