Tenant rent increament

(Querist) 04 October 2013 This query is : Resolved
Dear Sir,
I am residing in a house in South Calcutta, Westbengal on rented basis since last 2years. Suddenly my landlord told me that from the 1st day of 3rd year which will starts on (01.11.2013) the rent will be increased by 15% monthly.
I wanted to know that is this legally right ?
What step should i take further.
Please help me.

Dear Experts, I had read a article about this on the website of west bengal govt. "West Bengal Act VII of 2009 - The West Bengal Premises Tenancy (Amendment) Act, 2009" according to that act the rent will automatically increase by 5% every three year till 10th year of occupying the premises. I wanted to please highlight about the issue.

You have not made any mention about the terms of your agreement, if any signed.

However, you may try to settle by mutual discussions with your landlord on the basis of the provisions of the Act, you referred.

If no agreement is signed, he may also try to evict you, if no mutual agreement on rent is arrived at.
