Tenants right's in case of parking dispute

Hi, first of all i would like t thank all for bringing up such a great domain which helps and provides knowledge to all in any legal aspects.

I am residing as a tenant in a C.H.S the earlier when i had taken the flat i was told that i would be charged RS.30 per day for my second car that i own as my father has car dealership business he tends to change cars as and when the other one gets sold.

few days back society came up with a new rule to not allow any visitor's vehicle and have stickers on all the society car's parked.When requested to allow and give permissions to get the vehicle they stated only one vehicle will be allotted to Tenant's and that to permitting only a single car no change would be allowed.

In my fathers business we cant keep one car because as and when he sells it we buy another.

It has also been observed that other society members are allowed 4 car stickers and also when an authorities visitor comes in thier car is parked with in the premises
i want to get a advice how can i tackle such a problem !

Since your father is into Second hand car business....the society will have a upper hand.

If the things are not known to them then better talk to the society people.

Dragging this issue to the court is not advisable...after all you are not allowed to run business from a residential premises....

how many car parking slots are vailable in society? each member is to be given one car parking slot . if more slots avilable then you can get additional slots .


in your case you are a mere tenant .if some mebers are being given 4 slots you cn ask owner of flat to raise issue in society . let him draw attention of managing committee to discrimination against other members .
if no action taken in MC then raise issue in AGM .

1. Earlier you were told about the permissibility to have another car ?? How ? is it documented ?

2. If it is - they could not unilaterally change the rules to your detriment.

3. Take this issue up strongly in AGM.

First i would like to thank you from the bottom of my heart to sort my problem

They are very well known to all things and its not that we operate from our house it is just that we have a tendency to use diffrent car's on work in basis as for example he needs to go to pune tomorrow for some work for which he h=needs to take a particular one. earlier we used to park in our premises but now i have to park it in my friends house about half a km away

The authorities know it very well and my landlord also req. them for the same but the staright away bully stating that if they cant abide by our rule tell them to shift away
in regards to documentation and earlier rule i was paying their charges and everything was going right.But as we are the only tenants who will face such problem they are not changing the same

exactly outside the gate we have the no parking zone a couple of times my car has been towed.dont know what to do....even asked them to allow me to just park my car in night but they are way too adament....


How ever when any authorities relatives come they allow thier car with any lame excuses.......not even that there are many other residents who have tried to get this stupid rule kicked of.....as this causes problem to them also....but they are adament for thei step dont know how to go about PLEASE HELP !

ask the owner of flat to drag society to cooperative court . ask him to challenge the rule

That is unlikely to happen. Whatever the slots were alotted to the owner can be conferred to you.
