I live in rented flat I faced plumbing issue last months for that my landlord forced me to pay half of the money and he aruged with me also.Now my washbasin pipe is leaking and I asked him to repair again he asked to me to do so.as he doesn't want to pay for it.so I want to know is it correct.?

Instead of searching for Legal Remedies approach it reasonably. When you had taken the Premises for rent the Wash Basin was in Proper Condition only and the damage was caused by your Usage only.. Your House Owner had shared 50% in the Plumbing issue in your rented premises which is reasonable and acceptable also. Your query posted here sounds unreasonable.

What are the terms and conditions of tenancy, go through the document if any?

These are petty repairing, if not included in maintenance, should be paid by tenant if otherwise not agreed in rent agreement.

Should avoid dispute on such matters.

Legal relief is costly affair in reference to cost and time. Adversely affect the routine, should be avoided till left with no alternate.

Even if the issue is genuine, the courts are not working these days of covid-19 properly and you cannot get any relief therefrom despite of incurring many time more cost of litigation till many years to come so better to amicably settle the issue. The cost of the Washbasin pipe may not be of more than Rs. 100/- so do you think that you should raise this issue before Court of Law?

The condition that the tenant will have to pay half the charges towards the damages caused during his use of the premise is an excellent proposition and there is nothing illegal in it. The condition is not in favour of the flat owner but slanted towards the tenant.

It imposes a restraint on the part of the tenant in carelessly using the infrastructure at the premises. Otherwise the tenant may naturally use everything without proper care.

In short, as everyone says, there is nothing illegal in it. On the other hand it is a good condition that needs to be replicated in every such occupancy.

More than the Law, such cases need to governed by equity and good conscience. Such repairs may arise because of rough use as well as wear and tear caused by the tenant.
