iGreetings to all,
My name is sapna I have joined the organisation named Temenos+Agility a unit of VD Indus pvt Ltd on July 1st 2015 with a pay of 25000 per month and even fixed bonus 10000 per month with 3 months notice period. so on february5rmth 2016 they terminated on the grounds of non performance with a verbal communication saying they will give me 90 days salary support immediately. I accepted but they paid only for Feb month salary and March they didn't and now they are saying there is no evidence of my work so they will not pay my salary and even the offer doesn't have any clause for termination. they don't have proper hr documents. they have deducted PF amount but nothe given PF account number. I told don't give my bonus atleast give PF amount salary and mobile bill. they are saying no
I am singal parent need money
1. What is the best way to explain management
2. I am eligible or not for the salary support
3. how can I get my payment
4. whom should I approach

Well, this is the problem with private sector job as legal recourse is only civil suit which takes both money and time for result.
Hence send a legal notice claiming the dues. if they pay then it is alright else you have to move on.

First search for another job, send notice followed by the legal notice.
Discuss with local lawyer and show him all the documents.

First thing First: You may show all employment related docs examined in detail and designation and nature of duties examined by an able Labor Law Consultant/Service matters lawyer and your counsel can opine if you shall be covered by the def. of 'Employee' as in Shops & estbs Act, 'Workman' as in ID Act and standing orders (model/Certified) shall be applicable to establishment/your designation or not.
You should also record (audio/visual/witnessed/minuted) the verbal termination and lay a claim to 90 days notice pay and all related benefits.
Once you have irrefutable evidence your claim may have force.
Thereafter you should build written record and claim that you were terminated verbally on dated...............by Mr/Ms........and were prohibited to enter office from dated............and asked to remain at your address in records and all payouts e.g notice pay/bonus /mobile bill reimbursements etc shall be supplied at your address. However only for the month of ..............these have ben supplied and after that no payment has been made despite your representations on dated..........by phone/email/letter/SMS etc to Mr/Ms.............
If you are unable to handle on your own, entrust to an able counsel specializing in labor /service matters and take help of employee/trade unions.
