Terminated from psu job , new central govt job problem.

Dear Sir,
Previously I worked 1 year in psu , but I was terminated from psu as I have done multiple applications during psu exam.
Now I got a new central government job and I have mentioned details about my psu job in attestation form. Now after background police verification, psu has given a adverse report to my new central government job. Now new central government job not issuing my appointment letter as they got adverse report from my previous employment. So what can I do now. Please suggest me.

You have two options, one is to approach CAT against the decision of the Central government for rejecting your employment based on a blunt background verification report alone without ascertaining the facts alternately you can approach high court with a writ petition against both the central government as well as the PSU for spoiling your career and for direction to the central government to set aside their rejection order and allow your employment if other aspects are found to be correct and proper

What was the reason because of which you were terminated from PSU Job?

PSU must have mentioned the same to Central Government in the background verification, since you mentioned about your PSU job while applying for Central Government job.

Unless the reason why you were terminated from PSU job is analysed, matter cannot be further proceeded.

My psu job was terminated because I have done multiple applications while applying for job. In notification there is a provision for only one application. But that time I was not aware of that.

You have admittedly committed an of unbecoming of an employee hence there is no error on the part of employer to furnish adverse report in the background verification form.

Termination - It is non stigmatic and causes no ineligibility for govt service. Only “dismissal” crates disability for future govt employment and “dismissal” is possible only after process of chargesheet and inquiry is followed flawlessly.

For termination the process of chargesheet and inquiry is not there.

It is so far understood (as per facts shared by you) that :-

1. The PSU terminated you (not dismissed).
2. The central govt was expected to conduct police verification but they verified facts from PSU as well.
3. PSU is now reporting some material (not shared with you) causing disability)

(Give correct facts if above impression is wrong)

The conduct of PSU appears (at least from the facts so far shared):-

1. They fund and irregularity.
2. Primafaie competing for two posts in same organization (in same cadres) does not appear to be any offence or irregularity but PSU in the best of their wisdom treated it an irregularity.
3. They did not want to follow long tedious and meticulous procedure of chargesheet and inquiry.
4. They are not interested in to create a situation that their “termination” should have effect of “dismissal”.

It is also not understood as to on which rule/regulation they wrote to PSU.

Given facts indicate you to have a good case to be filed in CAT. However if any vital fact is not shared then the advise may change on knowing such hidden facts
