i am working in bpo company now the process is ramp-down(finish), they say we redeployment to u other process u need to sign a stamp paper u will get 3 chance to interview if u not clear u resign from your current designation what is the law of force to resignation or termination without any reason
Devajyoti Barman (Expert) 12 January 2014
There is no law for employment if the same is of managerial level.
However both parties are bound by the agreement with regard to job contract, if any.
Sudhir Kumar, Advocate (Expert) 13 January 2014
no considered views in this regard can be given without seeing papers.
Advocate. Arunagiri (Expert) 13 January 2014
If the company is sick, they will terminate all the employees. This terminated employees will not get employment, due to adverse feeling.

Practically speaking, it is better to resign get a relieving order and experience letter and try else where.
Rajendra K Goyal (Expert) 13 January 2014
Agree with the expert Advocate Arunagiri ji, when the company is sick, better leave it and try to get job otherwise.

If the company terminates you on account of its shut down that would fall under the scope of retrenchment.

But, you have not clarified about redeployment with what terms and conditions on the stamp paper?

If still you are required to go through the process of three interviews, that would mean a fresh appointment in some other company with fresh term & conditions of the new company and that too only if & when you are selected through the interview process. That means no guarantee of job.

Contrarily, by virtue of agreement or bond with the employees, the company seemingly intends to save itself from the legal formalities, like, (1) notice of termination, (2) notice period pay to employees, (3) retrenchment compensation/ gratuity, etc., as would be permissible to the employees due to their retrenchment.

In fact, redeployment in any other company should be on as is where is basis with the same terms & conditions under which the employee is already working in the present company.

So, you can expect mere cheating by signing any stamp paper in the name of redeployment.
