Querist : Anonymous (Querist) 09 November 2011 This query is : Resolved
Sir,
I have a plot , Allotted by Urban Improve Ment Trust by Lottery system, But the amount for the said plot was payed by my father.
DOES HE HAVE RIGHTS ON MY PROPERTY , CAN I SALE IT WITHOUT HIS CONSULT, Original papers are also with my Father, But every where in Legal registrations & Doxes it is my Name ONLY.
father paid for my plot as he didn't pay in my Marriage expenses.

If the property is allotted in your name and your name reflects in the transfer deed as well as the allotee/purchaser then you continue to be the absolute owner of the property and loss of the deed is no impediment in exercising your ownership over it and freely deal the same.

You can in the meantime apply for certified copy of the deed.

you are the absolute owner of the said property .however since original documents are with your father you will find it difficult to sell without your father consent as every buyer will want inspction of the originals
apply for certified copy

Since the property has been allotted in your name so you are absolute owner of property and the same can not be sold by your father.you can obtain certified copy of deed.

Please appreciate ethics plays bigger role than legal, which is more important than legal opinion to create better atmosphere in the socity and create bond in the family as well. this opinion will lead ruining of family relations and thereafter also this allotte will not be able to get whole of te property. property is purchased from the family fund and this is HUF. Price of the property may be very high but not igher than relation inthe family.
