Title Clr. Certificate

Dear Folks
I need your help for the Drafting of the Title Clearence Certificate ( After serving Notice at public through the News Paper), Can I issue the clean certificate to the party for the property ..

Please advice me & forward me the Format in which I should issue the same.

yes, you can issue title clearance certificate to the party. in title certificate you have to write the assignment of property for last 30 years and on what basis u reached to the conclusion of title clearance of the property.you have to conduct a search report from sub-registrar of assurance office.

Title clearance certificate
On the request of Mr.XYZ aged adult residing at a village of taluka of district of state of I have searched the titles of Land survey no/block no/admeasuring sq.meters situated at village----Taluka---district---State ---more particularly described under the schedule "A"appended here under.
I have serched records of subregistar office vide search receipt no.---Dt---for more than last 30 years.I have persued Nagarpalika records and city survey and urban development authority records and Newspaper Nitice. found that .
1.Search in sub registrar reveals that the sceduled property was purchased by late so and so who is the grand father of xyz on dtd.---by registered saleded vide No.---Dt--
/12 and Hakpatrak form 6 shows that the property came in the name of father of xyz and on expiry of his father came in the joint name of family members and entry in form no.6 number dated show taht all family member has given consent to take property in xyz name.2.City survey records also show the same types of entries vide entry no. date.3.News paper notice is issued and no any objection is received.
(This way each documents to be dscribed and see the status of property).There are no civil suits pending on the land as xyz has not received any notice and he has filed affidavit therefor.
I have gone through above documents and made necessary inquiries and come to the conclusion that the scheduled property is free from any encumberances and its titles are clear.
Certificate:
SCHEDULE A
Land admeasuring 0000 sq.meters situated at --village/taluka/district/state/survey no./flat no./society name/bounded by
1.On North
2.On West
3.On south
4.On East
is in the name of ---- and is free from any encumberances and having title clear in the name of -----.

1. arrange all deeds in cronologially
2. check carefully the transfer of titles, survey number, boundary, measurement, place of the suit property in above said all the documents.
3. Then clarify all the patta and chittas and adangals (i.e. revenue records)
4. Check the birth certificate, death certificate, legalhiership certificate
5. then you draw a geneological tree and mentioned how the property comes from one to another.
6. Finally you finds the property stands in one person, and other related documents are supporting to your findings then you may give the title certificate.

You should mentioned in the title certificate that what papers been verfied and checked by you at the time of clarification.
my kindly advise to you. dont do that work by free of cost. You collect a nominal fee from that person

I would sauggest reference to the formats of title certificates contained in the book "Practical Guide to Deeds and Documents" by G.M. Divekar and related discussion on the meaning of marketable title.
