To knw abt property share

Dear sir

since i got married and my wife has a independent house in bangalore and his parents have one son and daughter(my wife)
son fought and took some money from his father and left the house since 8 yrs past and dint return back
then his father got paralysed and since then daughter(my wife) takes care of her parents and his parents transfered the property to her name "gift deed" so i want to know suppose he comes back ,,,and ask for share is he elgible for share and one more thing my wife can she sell the property without him

If they are the ancestral properties of the ur father in law, then his son will have equal share along with theother coparceners. If it is self earned property of your father in law then your father in law can transfer to any body. If it is presumed that it is self acquired property of your F-I-L and it is gifted to your wife, so there is no problem to your wife to sell anybody wihout his brother.

Mr. Venky,

I agree with Mr. Rajeev,

If the properties are self acquired by the grand father there is no problem. If the properties are ancestral nature son also has the equal rights in respect of that property.

Already your wife acquired that property through the Gift Deed. So if she want to sell any body, disclose all these things and actual facts to the proposed purchaser and also take the paper publication in this regard.
