To lodge a police or cheating case forged promessory note

My aunty filed a money suit against my father for 4 lakhs rupees in May 2013 by creating a forged promissary note. My uncle(aunty's husband) & some one else are the witness. How can I file a case or lodge a complaint against this cheating. our advocate filed reply petition. Until Now I could not get copy of promissary note , they say i will get it only when it is exibitted.I have placed a Grievence petition in july 2013 before superintendent of police, still it is under enquiry at local police station.

Check the civil suit. The copy of Pro note must be there. You can apply for its xerox certified copy.

You can apply for a certified copy of the pro note. You can file a petition on the same civil court, u/s 340 cr.p.c. for filing a forged document.

Our local inspector in charge says give me a complaint about forged promissary note, and he will book a 420 case. Is it possible when money suit in court.

There is no bar in filing a cheating case, but once the matter is already in the civil court, the police action may not be effective.
