To transfer of dda flat

Hello
I param pavitra lal my father died on 5 july 2012 leaving a flat with a will registerd in court to my name and we are four brother & sister's my both sister's are married and lives in delhi and a brother who is also currently living in delhi. so do i need NOC from my brother & sister's regarding change of ownership. please suggest.

File a petition for probation of will executed by your deceased father.
Engage a local lawyer.

Yes, apply for Probate. To get smoothly you however need NOC of your other brother, sister, if any as they can dispute the Will in court.

Though Getting a will Probated is not LEGALLY necessary in DELHI FOR MUTATION OVER
TESTATOR'S PROPERTY BUT IT IS DESIRABLE FOR IT'S INHERENT BENEFITS.

Probating a will can be beneficially. You would not require any no objection from any of your siblings after that.

probate is not necessary in delhi . apply for mutation of property in your name based on regd will . obtain NOc from other legal heirs . if they refuse to give NOc then only apply for probate
