Torture and attemt to kill by employer

Dear Experts,

I had joined ICICI Bank Ltd as Assistant Manager II on 11th April, 2007 and was posted in Kolkata.

I have been being tortured, harassed and exploited in such a way that my family and me are now in a situation to die just because I cought some seniors redhanded exploiting juniors by misusing tools of organization.

I was transferred in three different locations in only three months time without transfer reimbursement, my salary account was marked lien to financially harass me, my request for medical help, an employee benefit, for my seriously ill wife was illegally rejected to harass me, bad annual rating to mentally harass me, abused and threatened by HR Head and finally no permission to continue my job since July, 2010.


Till date, I have not received any written communication from company about my job status.


Seniors have misused all tools of organization to kill my family and me like forcefull transfers to disturbed location like Jagadalpur, lian of salary account to kill us by starvation, denieal of medical benefit and making me illegally vanished from system to ruin my career and make me unable to earn further.

In this situation, I want to take action against seniors for torturing, exploiting and attempt to murder.Please suugest me what actions I can take to get permission to continue my job and get reimbusement for my losses?

contact a local lawyer . does bank have a union . raise it with the union . if you caughts eniors red handed what action was taken by bank against said seniors? send a complaint to MD of your organisation narrating entire sequence of events and ask for justice

Dear Expert,

I have already taken all actions as you suggested. I wrote to MD & HR Head. I wrote to All india Bank Employee Accossiation, I wrote to media, cheif justice of india, president, prime minister, cheif minister WB, Ministry of Labour Central and State, but no action.

Company has taken action against seniors. They were asked to leave organization but no relief for me.

The allegations you levelled are all very serious not only for an individual but also for the society at large.

If you belong to backward class then you can bring criminal prosecution against the erring officials of the bank.
Do not keep shy, wake up and raise voice by going to court. nothing would happen to your job.
Mere writing letters to those authorities would be of no help.

You being from the Kolkata should have taken concrete action much before.

Dear Expert,

All my financial benefits have been stopped intentionally so that I can not take any legal action against seniors of ICICI Bank Ltd.

I have contacted media, political leaders, social workers, highest authorities, but, exactly as you said, no help.

I have proves but still no one is ready to help me. My whole family has been suffering. My kids do not go to school because of my present financial situation. I am not even able to join any new company.

I need legal help

Today, I have come to know that my letter, sent to ministry of labour, has been rooted exactly to Regional Labour Commissioner(Centre), west bengal, as suggested by Expert Sudhir Kumar.

As mentioned by Expert Debojyoti Barman, yes, I belong to OBC catagory.

Your lawyer can prove that the transfer was malafide.
However submit the claims under acknowledgment and demand payment along with reasons for non payment from Chairman and MD.

You are owner of this a/c in which your wages are paid.
If you do not owe any amounts to company e.g. due to loan/debt, loss caused by employee to company, how can the company mark a lien?
You may ask for certified copy of the a/c opening form and check if there is any column of explicit consent to mark lien, right to set off in the a/c opening form and go thru the conditions under which lien can be marked.
Did the employer issue and supply any notice to you before marking the lien?
You may raise these questions to Chairman-Chanda Kochar and request to supply you the certified copies of the salary a/c opening form, details of the bank employee who has authorized to mark the lien, communication on the strength of which lien has been marked, grounds and reason for marking the lien, copies of notice sent to you and POD for marking the lien etc………….copy of Code of Bank’s committement to Customers, Fair Practices Code, list of Code Compliance Officers…
You may raise a query to Code Compliance officer also.
You may also report the matter with details to Governor –RBI-D.Subba Rao : governor@rbi.org.in

Seek an appointment from Chanda Kochar in writing under acknowledgment, issue reminders, and explain the matter.

Company must have shown the premium of Mediclaim/Group Insurance policy in your CTC sheet and must have issued I.Cards with policy numbers to you.
Is there any Mediclaim helpdesk in your company? Have you submitted your claims under acknowledgment to company within stipulated time e.g. 7 days?
If the claim has been out rightly rejected or some objections have been raised? You may fulfill the requirements and submit to Head-HR and TPA or Insurance Company.
You have the option of lodging the complaint with Chairman- IRDA.

You submit from your end and inquire and do not forget to quote the names/designation/dept/address of the company personnel who have stated your employment is doubtful and/or you can not attend office.

Get in touch with your lawyer with copies of all documents and let your lawyer structure your representations.

Seek the counsel of Mr. Burman.

----Represent to Chairman of Minorities Commission, and meet the Commissioner at your location.
Sensitize your community leaders and take with you.

----You may discreetly go thru Whistle Blower Policy of your company if any?


You have succeeded in throwing the offenders out of the company now you have to put in efforts to get reinstated.

Your reinstatement shall be a loud slap on the faces of these offenders.
Did you lodge any police complaint? If you were threatened and you have evidence, you can.

If you fell and only if you feel circulate, from any email id that you may create: the vitae/details with photo of these offenders to all placements agencies, employers with highlight of their deeds and with note that they were terminated.If any DDR/FIR was filed cite the number.

Dear Experts,

My immediate senior, under whom I worked only for three months out of my total span of three years in ICICI Bank, gave a disingenuous performance feedback. In fact, said feedback had nothing to do with actually my performance in company but was given out of personal jealousy and complex. My that senior had been staying in a nearby slum area while I stayed in a big appartment next to her house and had car.

Dy General Manager of ICICI Bank responded erroneously to my mail violating protocol of an organization. Dy General Manager could not write the word SENSITIVITY properly and had given erreneous feedback on SENSITIVITY.

My senior was the authority who intentionally marked my account lien to harass me. I had to lodge a complaint with RBI ombudsperson and ICICI Bank was asked to respond to me but no reply from Bank, on the contrary, I was held illegally in office by HR and threatened to withdraw the said compliant.

In our system there are authorities like CIBIL to decide and rate the creditworthiness of an individual but individuals do not have system to highlight and rate creditwothiness of a Bank. Icici bank itself failed to make me payment to my dues from Bank while for that default of Bank my name was registered on CIBIL as defaulter.

Medical help was a cashless medical support through ICICI Lombard, group company. As per rule of company, my employer has to give approval for cashless treatment before beginning of treatment, an employee benefit, was intentionally not done and approved while I had sent request for approval.

I proved and have proofs that performance appraisal tool of ICICI Bank to promote an employee is misused by seniors so all these illegal and unethical steps have been taken against me to harass me. I have proofs that seniors in ICICI Bank hire employees against money and to create that gap they throw existing employees out on basis of false allegations. Senior Management of ICICI Bank pressurizes employees through forced location transfers.

I contacted CEO of company on several occasions but no relief for me because CEO is also part of senior management.

Currently, as my current situation due to no job for 3 years, I do not have money to hire a Lawyer. This situation of mine has also been created by senior management by not allowing to continue job because once I will have sufficient fund then I shall use that to hire experience lawyer to handle my situation while for seniors they use company infrastructure to safeguard themselves.

Seniors of company have been torturing me to put me and my family in a suicidal situation.

Exactly, my reinstatement will really be a slap on senior management this they also know so they have been avoiding me.
