Transfer of agricultural land from father to son.

(Querist) 14 March 2016 This query is : Resolved
Dear Sir,

My father had purchased a agriculture land (6 Acers ) 14 years back in solapur, now he want to tranfer 3 acers of that land to my name.
I have three sisters and my father want the rest of the 3 acres land to be kept on his name.
Also we want that there should be separate 7/12 of my name of that 3 acres.

Sir,kindly advise how can we do this.

Do we need to pay stamp duty to get separate 7/12 of my name.

Being a self acquired property, your father can gift the property. Get the gift deed executed and subsequently, have the mutation carried out in the revenue records.

Stamp duty needs to be paid at the rates in force in the State.

Gift deed can be the best option for you to save on stamp duty and registration charges.

Dear Venu sir,

Thanks for your reply.

I have a query regarding gift deed.

Once the gift deed is executed, can my sisters challenge it in future.

Also can i get separate 7/12 of my name after the gift deed is executed.

Your reply is highly appreciated.

Sister can challenge; but unlikely to win unless there are infirmities in the Deed itself.

Once document is registered, carrying out mutation is only a formality.
