Transfer of case

(Querist) 14 May 2015 This query is : Resolved 
FIR was lodged on directions of court during year 2010. Police put up cancellation report to court during year 2011 on point of jurisdiction. Court did not accept and directed police to investigate accordance with law. Police again during the year 2013 submitted cancellation report and we received summons titled Kaur Vs State. My advocate submitted objection reply to court and requested that FIR may not be cancelled and may be transferred to concerned police station where the offence occurred. Than police after taking number of dates from court submitted reply that case cannot be filed due to jurisdiction. That court put up for consideration and my advocate again argued that FIR may be cancelled. The Judge just wrote on case file that SHO directed to re-investigate. My query is that no order is loaded on internet on court sites and it shows case status : Case Disposed. Nature of Disposal : Uncontested - Rejected. Please can you help me to understand what what this means when I have contested the case how it mentioned Uncontested or is it applicable to police. Please clarify.

Dear Kaur,

Website merely shows status of case. If you need to ascertain any further details, you need to obtain the order copy (by making a copy application) and have to obtain and peruse it for yourself.

My advocate has told that Judge have only written on the case file record which reads as under : that case record file alongwith documents in original is sent to concerned SHO of police station is to comply with orders and re-investigate. Hence there is no copy of court orders. Further the police for the last 5 years not preparing any charge sheet nor challan and time after time putting in court cancellation report and which almost takes more than a year. The IO in the case is not even transferring the FIR to concerned police station according to its jurisdication.

Dear Kaur,

Pay your Advocate, the balance professional legal fee if any, and request him again for copy of the court order. If that doesn't work, change your Advocate.

Prey for the copy of the orders and in case of need have second opinion from other lawyer by showing all documents.

You can get the order copy by applying for the same, just reading the status in the ecourt diary will not convey the correct status of the pendency of the case.

The Judge have written in his own handwriting on the order sheet to concerned SHO to comply with previous orders of Court.
