Transfer of common areas to the local authority

Transfer of Common Areas in a common interest development to the Local Authority is primarily to ensure that the builder do not encroach and construct unauthorized structures n common areas.
Can the Local Authority insist on transfer of common areas for free and then insists of leasing back to the owners at a very high lease amount.
Nominal lease amount of Rs 1 or so is understandable, but leasing for many hundreds of lakhs back to owners seems unjust. This is tantamount to unjust enrichment of local bodies for free!
Can any one weigh in on the legal aspect of this?

What is your actual problem? why dont you discuss your own problem instead of shooting academic queries, if at all you are really interested in getting some solutions to the crisis that you face.

Our housing society (consisting of high rise and also villas) in Bangalore handed over the common Area land to the local body. The local body handed over the common area land back to the society for a lease of 33 years for Rs 50 Lakhs! The transactions were orchestrated by the builder!
Is there any statute supporting such enrichment of the local body at the expense of the citizen owners?
