(Querist) 10 July 2015 This query is : Resolved
The chief judicial magistrate is transfering the criminal inquiry to other magistrates without any order is it right prosiger?
dev kapoor (Expert) 11 July 2015
Hi Javed
CJM is legally competent to transfer any criminal complaint pending inquiry before any subordinate JMIC,within his jurisdiction,to any JMIC falling in his jurisdiction. He need not assign any reasons therefor.
Never mind the JMIC whom the complaint will be transferred can equally deliver expected justice.
Dr J C Vashista (Expert) 11 July 2015
@ Javed,
Do you have any reservation or objection in the authority vested with CJM to transfer a case to any of his subordinate?
CJM is competent to do so.
