Transfer of name

Dear all in our housing society a flat is in the joint name of three persons
1.ramchandra kotekar
2 suresh ramchandra kotekar
3 dilip ramchandra kotekar

now ramchandra kotekar is died
so pl. tell me that can we trf. the share certificates in the name of other two persons & this new members can make nominations or not as old nomination is not taken

pl. give me all the details

did ramchandra kotekar leave behind a will ? or nomination?

his share in flat will devolve to his legal heirs

From your query it is established that Flat/apartment is CO-OWNED by three persons ONE among those named 1.ramchandra kotekar HAS DIED INTESTATE (that is without any Will)

In my OPINION his share(which is 1/3rd) will go to his legal heirs who in according to law may be his WIDOW(if alive)MOTHER(if alive)SONS and DAUGHTERS(if any predeceased then their sons and daughters)

It would be wrong to think that since he has died without nomination ,the flat will turn back to the two existing co-owners.
