Transfer of Property

Hi, We own a house in Hyderabad, India, which is on my father's name. My father expired recently. Right now we want to register the house on my mother's name. Can any one please suggest how to go about it and where to apply for it. Thanks.

You cannot register it in your mother's name. But your mother shall remain one of the legal heir/co-sharer for the house property and you shall apply for succession certificate in the name of the surviving family members including your mother and shall deal the property in the manner you want.

All legal heirs are equal sharers. rest of the sharers have to enter into relinquishment deed in favour of your mother,get it registered,and then apply to the competent local authority to enter your mother's name in the property register.

Basically transfer of property from one person to one or more persons on his death is not automatic. In your case, since your father has expired, his property becomes property of your father's successors. Wife of the deceased person and his children become successors. But, a succession certificate has to be obtained from the civil court by the successors and then all of you may relinquish your rights in favour of your mother and register the same. Only then, the property stands transferred in the name of your mother. However, you may enter your mother's name in khatha register of local administration.
