Transfer of property

Dear all,
Is there any way to get the property share transfer of of ex.husabnd on childerens name?It is oneof the point in MCD,the propery is bought by all ch payment by me but his name also was registered due to threat from him that he wont stay in the property bought.
Now he is reluctant to obey even court direction of to be present at registrar and sign,he is just passing time not attending court,arrest warant also been issued,can he go in appeal/or should i go in appeal as he is not fullfiling consent terms.
Please advise.

You have court orders, arrest warrants.


Hope you have his address and whereabouts also.


Get him arrested.

Rely on your lawyer, if he has said, "we will wait and see what he does".

However, if you have any doubt on the integrity of your lawyer, you may change him.

Sir ,
Thanks to all,i don't have doubt on the integrity of my lawyer,i have doubt on my ex husband as every time he brings something new to counteract us,he argues on his own whims n fancies without any actual facts,till past 5years he has changed almost 10lawyers,evey time new lawyer says we want to have counseling on consent terms decree ,we want to change 2tems,etc.twice counseling also done but failed due to his adamant behavior.
He himself has done law but don't have sanad.

If the name of husband is there in the property documents, it can not be deleted without his consent.

If you do not have faith in your lawyer, you can proceed to change him.

Dear all,
Thanks for the reply,i have faith in my lawyer, (past 15yeras I have same lawyer in my 3cases)..But our judicial system is slow as it takes so many years to decide the execution in court which I must accept now.
The person who don't want full fill his consent terms will try all ways to run away from it as he already got divorce and I am suffering as trusted that once consternation are filed in court the same will be respected by other party.

Judicial system is time and cost consuming.

Even in USA it is more expensive, time may be taken bit less.

It is irrelevant to blame the judicial system to be slow. That depends upon the dilly dally tactics of the lawyers of both sides. Law can't move at its own unless expeditious efforts of lawyers of both sides to bring in the evidence to get the cases accomplished in short duration. You have your own lawyer for the last 15 years. You would also felt how postponements are tried to be taken by both sides on one or the other excuse.

Even in the present case, you can see that the opposite lawyer don't make your husband to appear on the scene. If he is reluctant to obey even court direction of to be present at registrar and sign, there must be some flaw left by your own lawyer in your case for which he may be taking advantage.

Better ask your lawyer to fight effectively or consult some other lawyer making all the case related documents examined by him thoroughly. Such cases can't be resolved by finding solutions through casual queries here and there.
