hello ,
i want to transfer a house currently in my fathers name to my wife s name.
means by father will be gifting his house to my wife.
i am from kolkata i want to know the overall cost involved including all the legal process expenses approx. and also want to hire a good lawyer who can carry out the same and also the time involved in the process.

If it is self acquired property of the father he can gift/transfer to anyone.
Expenses for gift deed should be lowest.

sir it is a self occupied flat in a residential socieity .
i have haerd that transfer will require stamp charges as there must be some cost in registering the flat in my wifes name as we have to do probate etc will it cst me some lakhs??

In some states charges for Gift Deed to blood relation is waived off.
Your lawyer can inform you.
You may inquire from Sub Registrar's office.

sir i have googled its showing stamp charges is 4 % but you have to get the property valued by an approved valuer .were to get an approved valuer from in kolkata?? and does he value the property and what should be his qualification.

you may approach Kolkata High court to get Valuer.
In kolkata 5% stamp duty for Gram Panchayat area and 6% stamp duty for Municipality and Municipal Corporation area.

It is easy. It is a self-acquired property of your father (there is a difference between self-acquired property and self-occupied property), he can execute a gift deed. You need not consult anybody. You consult the concerned Sub Registrar Office. There will be document writers they will draft the gift deed and let you know the expenses.

The father can gift the property to daughter in law.
The approver valuer has nothing to do with the valuation.
You need valuation report from the office of registrar where the property is to be registered like Registrar of Assurances, Kolkata.
The fees in WB are-
Stamp Duty- 0.5%
Registation Fees- 1.1%.

There is no such thing called an official valuer has to value the property for stamp duty purpose. You an get the guideline value from the registrar office based on which even the local document writers will be able to guide you the further procedures in this regard, first make a visit to the local sub-registrar office, make a discreet enquiry about all the aspects you need clarification and proceed as per the information you had.
