Hello Everyone,
I had booked a Flat as co-owner with my Father in 2011. Unfortunately, In 2016, we lost our father. He left Four Legal heirs behind him (me, My Mother, Brother and Sister).
Now, I have given Death Certificate, Affidavit cum NOC from My Mother, Brother and Sister to the builder to transfer the under construction Flat in my name.
But, the Builder is asking for Relinquish Deed in my favour. Please suggest me if a Relinquish Deed can be registered for a property which is not registered in any land Record and I believe unregistered Relinquish Deed has no force and not admissible as Evidence. Please suggest which documents are required in present scenario. We have only Builder Buyer Agreement on Rs. 100 stamp paper and Receipts with us and no formal Sale Deed has been executed.
