Hello all. I am having a property which is on my fathers name. Original sale dead is lost which was made in 1984. I am having the certified copy.
I want to transfer the property to my mothers name or my name.
I want to know the procedure to get new papers made on my mother's name or my name.
Please suggest me how to proceed.

Your father should execute a gift deed in whose favor he want to change the ownership.

Since your father did not make any will or other document to favour your mother, all LRs of the deceased have a share in his property, which others (Other share holders)may relinquish in her favour.

To make a deed in your mother's name, all the legal heirs of your deceased father have to relinquish their titles by a release deed in favor of your mother, then on that basis, the entire property can be registered on your mother's name. If the original sale deed is lost and untraceable, lodge a complaint with the local/concerned police station, obtain a CSR(Acknowledgment) for your complaint, publish the same in all local newspaper, then obtain a certified copy of the lost sale deed, this will enable you to secure the property safely.
