Tress passing by adjacent property owner in my property

(Querist) 30 December 2012 This query is : Resolved 
I have agriculture land of 34800 sq,feet in Banswara(Raj) .My adjacent owner has enchroched in my land about 5 feet which is 208 feet long.Patwari has measured but other person is not agree.Now what can I do.Whether I can file a police complain or go to court.Kindly suggest me.

Police complaint would be of no help.
You have to file a civil suit for mandatory injunction.

Obtain the Site Verification Report from Tehsildar/Girdawar and on that basis file a civil suit for mandatory injunction but if the Khewat is joint then file application seeking partition before Tehsildar.
