If the cheque is issued in favour of the trust then the Trustee or manager of the trust can initiate proceeding for dishonouring the cheque.

A cheque payable to Trust on its bounce shall
give actionable rights in favor of Trust both under section 138 of N.I. Act as well as under civil law.

If such cheque is bounced on any reason then such trust in whose favour such cheque was issued can sue your brother.
