(Querist) 18 August 2014 This query is : Resolved
hello sir...
i am 27 years old. i appeared for civil services prelims exam in 2013 as OBC. But later i came to know that i belong to creamy layer. So for the next UPSC notification I should opt as GENERAL CATEGORY. Am I permissible to opt as general category for next time (UPSC received my first application as OBC).Does this affect my candidature.Under which category my first attempt will be counted.
Plz let me know sir

From the contents of the query, I presume you have attended prelims but not selected and now you wish apply again for prelims.
Mention your caste OBC and do not claim OBC reservation as you are above creamy layer now. YOu cannot rectify the mistake committed earlier now. At the most if pointed out you can plead that you were under the creamy layer at that time and now you are above hence you have foregone claiming OBC reservation though you belong to OBC caste.

Well advised by expert Mr. Jagga Rao, you can follow his advise.

But I am not having pleasure to agree.

You doubts a bonafide since UPSC is having a reputation of keeping meticulous record (even when computers were not heard off.

Since you belong to creamy layer, you cannot write OBC. Writing OBC means claiming reservation which you know you are not entitled.

even if you are entitled for reservation still you have privilege to mention yourself as Gen and not avails the concessions.

Your first attempt will be counted but better you may check with UPSC since it is more a matter of procedure rather than law.
