(Querist) 02 January 2010 This query is : Resolved 
1 My Grand mother (Tanubai) is 80 years of age has three sons
2 My Elder uncle (Vitthal)
3 My Second Elder uncle (Tukaram)
4 My Father (mahadeo)

My Grand Mother has piece of land at mahabaleswar

My elder uncle going to cheat us by my preparing a will and trying to take all her properties on his name under coercion . he took grandmother to his home since last six month and & does not let her go out side his home

I understand from the other sources that there is a strong chances of preparing a will without informing us

1 )What are the remedies available to others ?(at the least expense)
2) what preventive action we cant take so as to stop him doing a will ?
Should is send a notice to him or suggest me any other action to prevent him

I think that you can give him a notice to your uncle stating that your grand mother is very old,she is not mentally fit because of her old age to take decision, you have taken her into your custody against her will only for the purpose of getting signature on the will, etc. to show suspicious circumstances and if the will is done will be treated to have been done by coersion and undue influence on her and would not be binding.This will help you to protest his probate application.

First make a police complaint that your uncle is trying to coerce and cheat your your grandmother of her old age and obtain signatures illegally in a will. Then take the steps as stated by Mr. Nirajan.

If your grandmother says that she will her sweet will is with her elder son and she willfully wants to execute a will in his favour then what shall you do?

It is better not to do anything in the matter at present and take action only after the demise of your grandmother.
why to invite reaction from your grandmother at this stage....

You cannot stop ur elder uncle to do illegal things by issuing notice or filing police complaint. In this matter I agree with the Raj Sir Advise.
