Vacancy calculation for promotion

Hi Hon'ble experts!

I have a little query regarding the calculation of vacancies for consideration by DPC.

Q. For calculation of vacancies created out of retirement for a year say 2010, should we consider the clear vacancy arise out of retirement on 31st Dec 2010 or not?
Q. Any verdict on similar cases ?

That depends upon the rules or regulations of the office concerned.
